These Terms of Service ("Terms") govern your access to and use of the PolyDraft platform (the "Service"), operated by BlackMonolith, Inc. ("PolyDraft", "we", "us"). By creating an account or using the Service, you agree to these Terms.
PolyDraft is an AI-powered website builder. You describe your business; our AI agent researches, writes, designs, and builds a complete website that you can preview in the browser and, on eligible plans, publish to your own infrastructure. The Service is provided on a software-as-a-service basis.
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for your account credentials and for all activity under your account. Sign-in is provided through third-party identity providers (e.g., Google).
All prices are stated and charged in United States dollars (USD) and exclude any taxes that may apply in your jurisdiction. Paid plans (Starter, Pro, and Agency) are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe; Enterprise plans are offered under individually negotiated agreements. Current prices are listed on our public pricing page.
You are charged only when you actively subscribe. The first payment is taken immediately at checkout, and the subscription then renews automatically for the same period — monthly or annual — until you cancel. Each renewal is charged on the anniversary of your original subscription date at the price then listed for your plan; we will give you advance notice by email before any price change takes effect for your subscription.
You can cancel at any time through the in-app billing portal. Cancellation takes effect at the end of the period you have already paid for: you keep access to paid features until that date, and no further charge is made after you cancel. Cancelling before the end of the current period does not trigger a partial refund (see Section 7).
New accounts receive a starting allowance of credits at sign-up. If a card-linking promotion is running, you may claim a further one-time allowance of bonus credits by adding a valid payment card. Adding a payment card does not create a subscription, does not authorize any recurring charge, and does not charge your card — it stores the card for later use and grants the promotional credits immediately. No automatic conversion to a paid plan occurs, and no trial expiry date applies; you move to a paid plan only by explicitly subscribing.
Promotional credit allowances may be claimed once per account and once per payment card. We may decline or reverse promotional credits where we detect duplicate accounts, duplicate cards, or other abuse of the offer. Promotional programs and their amounts may be changed or ended prospectively at our discretion; a promotion in effect when you claimed it is not affected retroactively.
PolyDraft is a digital service delivered entirely online. Paid features and subscription credits are made available in your account immediately after a payment is successfully processed, and promotional credits are granted immediately upon a valid claim. Nothing is physically shipped, so no delivery times, shipping charges, returns, or exchanges apply. Access is provided for the duration of your paid period.
The Service meters AI usage in "credits". Credits are an internal unit of measurement for compute usage on the PolyDraft platform only. Credits are not money, have no cash value, cannot be redeemed or exchanged for cash, and cannot be used or transferred outside the platform. Credits included with a subscription expire at the end of the billing cycle in which they were granted; promotional or bonus credits may carry their own expiration terms; separately purchased credit packs do not expire while your account remains in good standing. Credit amounts, allowances, and promotional programs may be adjusted prospectively at our discretion.
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused credits, or unused features. Cancelling a subscription stops future renewals; it does not refund the period already paid for.
If you were charged in error, were charged after cancelling, or believe a charge is otherwise incorrect, email [email protected] within 14 days of the charge, including the account email address and the date and amount of the charge. We acknowledge every request and give you a decision within 5 business days. If a refund is approved, it is issued to the original payment method — we submit it to Stripe within 5 business days of the decision, and your bank or card issuer typically posts it within a further 5–10 business days. Refunds are always returned to the original payment method; we cannot redirect a refund elsewhere. Nothing in this section limits any statutory refund or cancellation right you may have under the law of your country of residence.
You retain ownership of the content you provide to the Service and, to the extent permitted by law, the websites and materials generated for you by the Service ("Output"). You are responsible for the accuracy and legality of content you publish, and you confirm that you hold the rights to the business names, logos, images, text, and other material you submit. We retain all rights to the Service itself, including its software, models, templates, and infrastructure. You grant us a limited, non-exclusive license to host, store, reproduce, and process your content and Output solely to operate, secure, support, and improve the Service.
Design patterns, layouts, component structures, and other non-identifying technical know-how that we develop or refine while operating the Service remain ours, and we may reuse them in the Service, including in templates offered to other customers. This does not extend to your business name, logo, copy, images, or any other material that identifies you or your business.
We may create aggregated and de-identified data from use of the Service — for example, statistics on build times, feature adoption, industry mix, language coverage, or output quality — and may use, publish, and retain that data for any lawful business purpose, including product development, research, benchmarking, and marketing. Aggregated and de-identified data does not identify you, your business, or your customers; we will not attempt to re-identify it and will not permit others to do so. This right survives termination of your account. If you send us feedback or suggestions about the Service, we may use them without restriction or obligation to you.
Sites published on plans that do not include the white-label feature carry a discreet attribution link to PolyDraft in the site footer. You can edit or clear it in your site's own settings at any time, but on these plans it is restored the next time you deploy. Plans that include white labeling let you remove it permanently, or replace it with your own agency branding.
We will not use your name, your logo, your business, or the sites you build in our marketing, case studies, or public galleries unless you opt in. Opting in is separate from accepting these Terms: we will tell you in advance exactly what would be published and what you receive in return, and your decision has no effect on your plan, your credits, or your access to the Service. You may withdraw at any time — withdrawal stops all future use and we will remove the material from properties we control within thirty (30) days, although copies already distributed, cached, or archived by third parties may persist.
You may not use the Service to create or distribute content that is unlawful, infringing, deceptive, malicious, or harmful; to attempt to gain unauthorized access to the Service or its systems; to resell or redistribute the Service except as expressly permitted for agency plans; or to abuse promotional programs (including creating multiple accounts to claim sign-up or campaign credits). We may suspend or terminate accounts that violate this section.
The Service integrates third-party services, including payment processing by Stripe and optional deployment to third-party hosting providers under your own accounts. Your use of those services is governed by their respective terms.
The Service is provided "as is" and "as available". AI-generated output may contain errors or inaccuracies; you are responsible for reviewing Output before publishing it. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, PolyDraft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months before the event giving rise to the claim.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, or as required by law. Upon termination, unused credits are forfeited except where required by law.
We may update these Terms from time to time. Material changes will be announced through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the District of Columbia, United States, without regard to conflict-of-laws principles.
